These Terms of Service (“Terms”) govern your use of the Perq app, website, and related services (collectively, the “Services”) operated by Perq App Ltd (“Perq”, “we”, “us”, or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services.

By using the Services, you confirm that:

• You are at least 18 years old

• You have the legal capacity to enter into these Terms

• All information you provide is accurate and up to date

We reserve the right to suspend or terminate accounts that do not meet these requirements.

2. Your Account

You may be required to create an account to access certain features.

You are responsible for:

• Maintaining the confidentiality of your login credentials

• All activity carried out under your account

You must notify us immediately of any unauthorised access or security breach.

3. App Licence (EULA)

Subject to your compliance with these Terms, Perq grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the Perq mobile application on a device that you own or control, in connection with your personal or business use of the Services.

This licence is granted, not sold.

You must not:

• Copy, modify, or create derivative works of the app

• Reverse engineer, decompile, or attempt to extract the source code

• Sell, lease, sublicense, distribute, or otherwise make the app available to third parties

• Use the app in any unlawful manner or in violation of these Terms

Perq reserves the right to suspend or revoke this licence at any time if you breach these Terms.

4. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You must not:

• Violate any applicable laws or regulations

• Impersonate any person or entity

• Provide false or misleading information

• Create multiple accounts to exploit rewards or platform features

• Interfere with or disrupt the Services or servers

• Attempt to gain unauthorised access to systems or data

• Use bots, scripts, or automated systems

• Engage in fraudulent, deceptive, or abusive behaviour

We may take action, including suspension or termination, if you breach these Terms.

We reserve the right to monitor usage, investigate suspected misuse or fraudulent activity, and take appropriate action, including suspension, restriction, or termination of accounts.

5. User Content

The Services allow you to upload and share content, including photos, videos, and text (“User Content”).

You are solely responsible for your User Content.

You confirm that:

• You own or have the necessary rights to upload the content

• You have obtained consent from any individuals featured

• Your content does not infringe any laws or third-party rights

6. Licence to Use Content

By submitting User Content, you grant Perq a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sub-licensable licence to:

• Use, host, store, reproduce, modify, adapt, publish, and display your content

• Distribute and share your content

• Use your content in connection with the Services and Perq’s business, including marketing, advertising, and social media

This licence allows Perq to make your content available to businesses using the platform where relevant to the Services.

You acknowledge that this licence includes the right for Perq to make User Content available to other users and businesses on the platform in accordance with the functionality of the Services.

7. Content Moderation and Reporting

We may review, remove, or restrict content that violates these Terms.

Users may report content through the platform. We reserve the right to:

• Investigate reported content

• Remove content

• Suspend or terminate accounts

Content involving illegal activity, including exploitation of minors, will be reported to relevant authorities.

8. Zero Tolerance Policy

We have a zero-tolerance policy for:

• Sexually explicit content involving minors

• Hate speech or discriminatory content

• Content promoting violence or illegal activity

Violations may result in immediate removal and permanent account suspension.

9. Child Safety and Protection (CSAE)

Perq is committed to maintaining a safe environment and has a strict zero-tolerance policy for any form of child sexual abuse and exploitation (CSAE).

Users are strictly prohibited from uploading, sharing, or engaging with any content that:

• Depicts or exploits minors in a sexual or abusive manner

• Involves grooming, solicitation, or inappropriate interaction with minors

• Promotes or facilitates child exploitation in any form

Any content or activity suspected to involve child exploitation will be:

• Immediately removed

• Reported to relevant law enforcement and regulatory authorities

• Subject to permanent account suspension without notice

We actively cooperate with authorities and take all reasonable steps to detect, prevent, and respond to such activity on our platform.

10. Rewards and Incentives

Perq may offer rewards, perks, or incentives through the Services.

Rewards:

• Are subject to eligibility criteria

• May be modified, suspended, or withdrawn at any time

• May depend on user activity, engagement, or other factors

Perq is not responsible for:

• The fulfilment of rewards provided by third-party businesses

• Disputes between users and businesses

We reserve the right to remove rewards or suspend accounts in cases of suspected abuse, fraud, or manipulation.

11. Businesses and Third-Party Services

Perq is a platform that connects users and businesses.

We do not:

• Provide medical, aesthetic, or professional services

• Endorse or guarantee the quality of any business

• Accept responsibility for outcomes of services provided by third parties

Any interactions, bookings, or transactions with businesses are solely between you and the business.

Content available on the Services, including user-generated content, is provided for general informational purposes only and does not constitute medical, aesthetic, or professional advice. You should seek independent professional advice where appropriate.

12. Third-Party Accounts

The Services may allow you to connect third-party accounts (such as Instagram).

By connecting a third-party account, you confirm that:

• You have the right to use and connect that account

• You comply with the terms of the relevant third-party platform

Perq is not responsible for third-party platforms or their policies.

We do not guarantee the availability, functionality, or continued integration of any third-party accounts or services.

13. Intellectual Property

All content, branding, software, and materials within the Services (excluding User Content) are owned by Perq or its licensors.

You may not copy, reproduce, or use any part of the Services without our prior written permission.

14. Service Availability

We may:

• Modify, suspend, or discontinue any part of the Services

• Introduce new features or remove existing ones

We do not guarantee that the Services will always be available, uninterrupted, or error-free.

15. Disclaimer

The Services are provided on an “as-is” and “as-available” basis.

We make no warranties regarding:

• Accuracy or completeness

• Reliability or availability

• Suitability for any purpose

16. Limitation of Liability

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

To the fullest extent permitted by law, Perq shall not be liable for:

• Indirect or consequential losses

• Loss of data, profits, or business opportunities

• Issues arising from third-party services or businesses

17. Indemnity

You agree to indemnify and hold Perq harmless from any claims, damages, or losses arising from:

• Your use of the Services

• Your User Content

• Your breach of these Terms

We may suspend or terminate your access to the Services where reasonably necessary, including if:

• You breach these Terms

• We suspect misuse or fraudulent activity

• It is necessary for legal or operational reasons

We may also restrict access to certain features or functionality of the Services where appropriate.
